Terms of Service

1. Acceptance of Terms

These Terms apply to all B2B clients, including established beauty brands, indie startups, e-commerce sellers, and contract fillers. Any custom requirements or deviations from these standard terms must be documented and signed in a formal Purchase Order (PO) or Manufacturing Contract.

2. Products and Services

Fomalhaut provides tailored packaging solutions, specializing in eco-friendly and premium cosmetic containers. Our services include:

• Sustainable Solutions: Provision of Post-Consumer Recycled (PCR) materials, mono-material All-Plastic PP Airless Bottles, glass, bamboo, and sugarcane plastics.
• OEM/ODM Manufacturing: Custom mold development, 3D design consultation, and mass production.
• In-House Decoration: Silk screen printing, UV printing, hot stamping, frosting, and spray coating.

3. Orders, MOQ, and Pricing

To support indie brands and diverse client needs, Fomalhaut offers competitive Minimum Order Quantities (MOQs):

• Glass Containers: Standard MOQ is 5,000 pieces.
• Plastic & PCR Containers: MOQs vary by material and design complexity; typical starting quantities are 10,000 pieces.

All quotes are valid for 30 days unless otherwise stated. Pricing is subject to change based on raw material market fluctuations. Standard payment terms require a 30% to 50% deposit upon order confirmation, with the balance due before shipment, following successful quality inspection.

4. Manufacturing & Lead Times

We pride ourselves on supply chain transparency. Estimated lead times are as follows:

Fomalhaut provides digitalized updates throughout the production cycle. While we strive to meet all estimated deadlines, lead times may occasionally be impacted by force majeure or raw material shortages. We will proactively notify you of any potential delays.

5. Quality Assurance & Compliance

Quality is integral to our manufacturing process. Every batch undergoes rigorous testing, including:

• Dimensional and thickness inspection.
• Impact, thermal shock resistance, and vacuum leak testing.
• Visual defect inspection for premium aesthetic standards.

All products comply with international standards, and we provide REACH, FDA, and RoHS certifications upon request. We also supply traceability and raw material testing reports for our PCR materials to assist with your brand's compliance to regulations such as the EU PPWR. Any claims regarding defective goods must be submitted in writing within 14 days of receiving the delivery.

6. Shipping & Warehousing

Shipping terms (e.g., EXW, FOB Shanghai, CIF) will be defined in the specific PO. Risk of loss transfers to the buyer according to the agreed Incoterms.

7. Intellectual Property

Any 3D designs, logos, or brand assets provided by the client remain the sole property of the client. Custom molds paid for entirely by the client are the exclusive property of the client and will not be used to manufacture goods for third parties. Fomalhaut retains all intellectual property rights to our proprietary standard catalog designs, engineering processes, and mono-material innovations.

8. Limitation of Liability

In no event shall Fomalhaut be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our products or services. Our maximum liability for any claim related to a specific order shall not exceed the total amount paid by the client for that specific order.

Clients are responsible for conducting compatibility testing between their specific cosmetic formulas and Fomalhaut's packaging prior to mass production.
